Terms of Use (AGB)
Draft for completion and legal review. These terms are not yet effective and must not be treated as accepted by existing users.
Draft version: September 25, 20261. Provider and scope
FocusMind is provided by Akram El-Kormany, Ocwirkgasse 11, 1210 Vienna, Austria. A monitored support email and any further applicable provider details must be added before these terms take effect.
These terms are intended for the FocusMind account and personal planning service. Mandatory consumer rights and any applicable app-store terms remain unaffected.
2. Service
FocusMind provides tools for personal planning, including goals, life areas, tasks, habits, notes, reflections, calendars, reminders, progress views and optional third-party integrations. Features can depend on device, platform, permissions and provider availability.
FocusMind is a planning aid, not medical, psychological, legal, financial or emergency advice.
3. Eligibility and account creation
The minimum age and any required parent or guardian authorization must be decided before publication. Users must provide accurate account information and protect their credentials.
A binding acceptance flow must be implemented for email and social registration before these terms can apply. A privacy acknowledgement is not a substitute for accepting the Terms of Use.
4. Price and duration
The current service is provided without a subscription fee. If paid features are introduced, their price, billing period and cancellation terms will be shown before purchase. The agreement continues until ended by the user or FocusMind under these terms.
5. User content and permitted use
Users retain their rights in content they enter. They grant FocusMind only the rights necessary to store, process, synchronize, back up and display that content to provide the requested service.
The service must not be misused to violate law or third-party rights, access other accounts, disrupt security or upload malicious content. Users should only add third-party calendars, feeds and content they are entitled to use.
6. Optional integrations and permissions
Social sign-in, calendar connections, location-based prayer times and notifications are optional and can require provider or device permissions. Third-party services operate under their own terms and may be unavailable or changed independently of FocusMind.
Disconnecting an integration in FocusMind does not necessarily revoke the provider grant; users may also need to use the provider account settings.
7. Information, reminders and limitations
Reminders, calendar imports, streaks, progress indicators, quotes and prayer times are informational aids. Users remain responsible for checking important dates and decisions. Do not rely on FocusMind as the sole reminder for safety-critical, medical, legal or financial obligations.
8. Availability, updates and changes
Reasonable maintenance, security updates and changes may be required. Continuous, uninterrupted or error-free availability is not promised. Mandatory update duties and consumer remedies remain unaffected.
9. Privacy and support
Personal-data processing is described in the Privacy Policy. A monitored support address and privacy address must be added before publication. Users must never send their password in a support request.
10. Ending the agreement and deleting an account
Users can stop using the service and request account deletion through Profile → Settings → Account. Uninstalling the app is not account deletion. Provider accounts and original external calendars are not deleted with the FocusMind account.
FocusMind may restrict or end access for serious or repeated violations, subject to applicable law and proportionate notice where required.
11. Consumer withdrawal rights
Whether statutory distance-contract withdrawal rights and an online withdrawal function apply to the current free, data-processing service must be legally confirmed. No waiver is inferred merely because the user starts using the free service.
The provider name and postal address are listed above; an email address and any required model instructions must be added before these terms take effect.
12. Statutory remedies and liability
Nothing in these terms excludes or limits liability or statutory remedies where exclusion or limitation is prohibited. Any liability clause must preserve mandatory consumer protections, including remedies for qualifying digital services.
13. Apple-distributed software
For software distributed through Apple's App Store, these service terms are intended to accompany Apple's Standard EULA. The actual App Store Connect license configuration must be verified before release.
14. Applicable law, complaints and disputes
Austrian law is the provisional governing-law choice, without depriving consumers of mandatory protections of their habitual residence. Jurisdiction follows applicable law.
An electronic complaints address and any applicable alternative dispute-resolution participation statement must be confirmed. The discontinued EU Online Dispute Resolution platform is not used.
15. Changes to these terms
Material changes require appropriate advance notice and, where necessary, renewed agreement. Changes cannot retroactively create acceptance. The final terms must identify an effective date and version.
